ORDER : The Court Made the following order :- The petitioners/A1 to A4, who were arrested on 23.10.2017 for the offence punishable under Section 395 I.P.C., in Crime No.1836 of 2017, on the file of the respondent police, seek bail. 2.The case of the prosecution is that on 23.10.2017 , the petitioners came in a Tavera Car and committed an offence by robbering the jewels from the defacto complainant and also robbed a sum of Rs.1000/- from him. Hence, based on the complainant, case has been registered against the petitioners, they were arrested and remanded to judicial custody.

3.The learned counsel appearing for the petitioners submitted that the petitioners are belong to the State of Maharashtra and they have not committed any offence as alleged. They are in judicial custody from 23.10.2017 onwards. Hence, he prays for bail. 4.The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that after completing investigation, charge sheet has been filed and the same is posted for trial. further submitted that the petitioners/A1 to A4 are belong to the State of Maharashtra, if they are released on bail, they will escape from the clutches of law. Hence, he vehemently opposed to grant bail to the petitioners.

5.The submissions made by the learned counsel on either side are considered. According to prosecution, as of now, after completing investigation, charge sheet has been filed and the case is posted on 22.02.2018 for trial proceedings. Considering the facts of the case that the petitioners herein are belong to the State of Maharashra. If they are released on bail, there may be a chance to non appearance before the lower Court. Further considering the gravity of offence committed by the petitioners, this Court is not inclined to grant bail to the petitioners. Accordingly, this Criminal Original Petition is dismissed.
