ORDER
This Writ Petition has been filed to direct the respondents 2 and 3 to take appropriate action against the fourth respondent based on the petitioner's complaint dated 04.12.2024.
2. The petitioner has sent representation to the second and fourth respondent on 04.12.2024. After sending representation by post the petitioner failed to appear for enquiry and give clarification.
3. The learned Additional Public Prosecutor submitted that the petitioner has sent complaint through post and thereafter he had not responded to the summons and did not appear before the respondent police for giving statements and producing documents.
4. The learned counsel appearing for the petitioner submitted that he has filed a suit in O.S.No.105 of 2023 and the same was dismissed, against which he has filed a set aside petition . 2/5
5. The learned Additional Public Prosecutor submitted that the complaint is bereft of facts and it is only imaginary and there is no details and particulars in this regard.
6. The learned Additional Public Prosecutor submitted that if the petitioner appears before the District Crime Branch, Dingidul and give details along with supporting document appropriate action would be taken. He also produced the summon issued to the petitioner for his appearance on 26.12.2024 before District Crime Branch, Dindigul.
7. The learned counsel appearing for the petitioner, on instructions, submitted that the petitioner will appear before the District Crime Branch, Dindigul on 28.01.2025 without fail
8. In view of the same the petitioner is directed to appear before the District Crime Branch, Dindigul on 28.01.2025 along with supporting documents and thereafter the District Crime Branch is directed to 3/5
conduct enquiry and conclude the same within a period of two months from 28.01.2025.
9. With the above direction the Writ Petition stands disposed of. No costs.
