O R D E R

This Writ Petition has been filed seeking a Writ of Mandamus directing the third respondent to dispose of the enquiry in Na.Ka.A3/1788/2024 within a time frame to be fixed by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel appearing for the petitioner would submit that the property in S.F.No.57/1A (presently S.F.No.57/1A3), situated at Neunjalkudi Village, Manthurai Post, Lalgudi Taluk, Tiruchirappalli District, belongs to the petitioner's wife, namely Chandrika, who had obtained the same through a registered Will dated 07.08.2023; that during the UDR measurement, the extent of land had been wrongly entered; that after obtaining the property, the petitioner made an application for issuance of a separate patta; that while issuing the separate patta, the extent was wrongly entered as 001.5 ares instead of 002.5 ares; that upon surveying the land, it was found that the petitioner and his wife are entitled to an extent of 002.5 ares; that therefore, an application was made Page No. 2 of 5

to the second respondent on 30.04.2022 seeking rectification of the mistake; that the second respondent forwarded the same to the third respondent, who has taken the same on file in Na.Ka.A3/1788/2024; that though the third respondent conducted an enquiry, no order has been passed; that thereafter, the petitioner sent a representation to the first respondent, who forwarded the same to the second respondent; that however, no order has been passed till date; and that therefore, the petitioner was constrained to file the present Writ Petition.

4. The learned Government Advocate appearing for the respondents would submit that enquiry would be concluded and appropriate orders would be passed by the third respondent within a period of twelve weeks.

5. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the third respondent to conclude the enquiry and dispose of the petitioner's application on its merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. Before passing any order, the third respondent shall provide a reasonable opportunity of hearing to the petitioner and any other interested parties Page No. 3 of 5

who may be affected by the decision. In the event of any rival claims, the parties are at liberty to pursue their remedies before the competent Civil Court. There shall be no order as to costs.
