Kalyani : Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents 1 to 4 to issue patta to the petitioner for S.No.361/14, measuring 1⁄2 cent situated in Pirammalai Village, Thiruppathur Taluk, Sivagangai District.

ORDER

This Writ Petition has been filed for the issue of a Writ of Mandamus directing the respondents 1 to 4 to consider the representation made by the petitioner, wherein, the petitioner had sought for issuance of patta with respect to the subject property.

2. The learned counsel appearing on behalf of the petitioner submitted that after filing the present Writ Petition, a subsequent suit came to be filed before the District Munsif Court, Thiruppathur in O.S.No.43 of 2013, against the fifth respondent seeking for the relief of declaration and other consequential reliefs.

3. The learned Government Advocate appearing on behalf of the respondents 1 to 4 submitted that the parties can agitate their rights before the competent Civil Court and depending upon the https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD)No.4006 of 2013 result in the civil proceedings, they can approach the fourth respondent seeking for patta.

4. In view of the above, no further orders can be passed in this Writ Petition and it is left open to the petitioner and the fifth respondent to work out their remedy before the competent Civil Court where the suit is pending. Depending upon the result of the suit they can approach the Revenue Authorities.

5. This Writ Petition stands disposed of accordingly. No costs.
