ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.3 in Crime No.331 of 2015 on the file of the respondent police, was arrested on 04.07.2015 for the alleged offences punishable under Sections 4(1) (A) of Tamil Nadu Prohibition Act and hence, seeks bail.

2. According to the prosecution, on 04.07.2015, when the Sub Inspector of Police attached to the respondent police was in vehicle check up, the accused were found in possession of each two bottles of 750 ml. of arrack.

3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that A2, who is similarly placed was already granted bail by the Judicial Magistrate, Padmanabhapuram.

4. The learned Government Advocate (Crl.side) submitted that the accused were found in possession of poisonous arrack of each two bottles and the petitioner has no bad antecedent.

5. Considering the facts and circumstances of the case, this Court https://hcservices.ecourts.gov.in/hcservices/ is inclined to grant bail to the petitioner with certain conditions.

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Padmanabhapuram and on further condition that the petitioner shall report before the respondent police daily twice at 10.00 a.m. and 5.00 p.m. until further orders. sd/- 04/08/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
