PRAYER : Writ petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the Respondents herein to absorb the petitioner herein into the service of the respondent Board for being employed as Contract Labourer from 1998-1999 under the second respondent division.

ORDER

The relief sought for in the present writ petition is to direct the respondent to absorb the petitioner into the service of the respondent Board for being employed as Contract Labourer from 1998 - 1999, under the second respondent division.

2. The petitioner states that he was employed on contract basis from the year 1998. He was continuously working for about 14 years on contract basis and therefore, he is entitled to be absorbed in the permanent establishment.

3. This Court is of the considered opinion that the issues regarding the permanent absorption of contract employees in Tamil Nadu Electricity Board are already settled. Thus, the respondents are bound to consider the case of the writ petitioner in the light of the Board proceedings issued in BP.No.9, dated 09.01.2008 and in accordance with the 12(3) settlement and if the petitioner is found otherwise eligible his case is to be considered by following the procedures and in accordance with law.

4.With these directions, this writ petition stands disposed of. No costs.
