ORDER

This Writ Petition is filed seeking a Writ of Mandamus directing the first and second respondents to survey and fix boundary stones in respect of the petitioner's land in S.No.165, measuring about 41801⁄2 square feet and situated at Ward No.23, Kokkulappi, Ponmeni, Madurai West Taluk, Madurai District, pursuant to the E-challan dated 07.10.2025, and directing the third respondent to afford protection during such survey, within a time frame to be fixed by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

The learned counsel for the petitioner would submit that the subject property is ancestral in nature and that the petitioner, by virtue of a registered settlement deed executed by his father, is in possession and enjoyment thereof. It is further submitted that the application seeking survey and demarcation of boundaries remains pending without any action.

4. The learned Government Advocate appearing for the respondents 1 and 2 would submit that proper steps would be taken to survey and demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923.

Recording the aforesaid submission, this Court directs the respondents to consider the petitioner's representation dated 11.10.2025 and demarcate the petitioner's land, after considering the claims of the petitioner and any other rival parties, if any, and to pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923, within a period of twelve weeks from the date of receipt of a copy of this order. It is needless to state that the revenue officials may seek assistance from the third respondent Police, if Police assistance is required while carrying out such survey. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court.

6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
