ORDER : The Court Made the following order :- The petitioner is the sole accused in Crime No.619 of 2015 on the file of the respondent police, was arrested on 09.07.2015 for the alleged offence punishable under Sections 4(1)(aaa), 4(1)(A) of TNP Act and Section 5 and 6 of the Tamilnadu Spirit Rules, and hence, seeks bail.
2. The case of the prosecution is that on 09.07.2015, when the respondent police was conducting the vehicle check-up, the accused was found in possession of 210 litres of spirit in six canes (each contained 30 litres).
3. The learned counsel for the petitioner submitted that the petitioner's uncle one Muthu was detained under Act 14 and only to put the petitioner also in custody, this case has been registered against him. He further submitted that the petitioner is innocent and he has got marriage recently and he has not committed any offence as alleged against him.
4. The learned Government Advocate (Crl. Side) submitted that the petitioner is having three previous cases, similar in nature and he is a habitual offender.
5. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on executing a personal bond for a sum of Rs.10,000/- (Rupees https://hcservices.ecourts.gov.in/hcservices/
Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.III, Dindigul and on further condition that the petitioner shall stay at Madurai and report before the Inspector of Police, Anna Nagar Police Station, Madurai, daily, twice at 10.00 a.m. and 06.00 p.m. until further orders.
