ORDER
This Criminal Original Petition has been filed by the petitioner, to direct the second respondent to register a case, based on the complaint given by the petitioner, dated 06.11.2017. 2.The learned counsel appearing for the petitioner has submitted that the petitioner and one Chandrasekar have entered into a sale agreement with one Shanmugam, with regard to purchase certain lands which are situated in Thottiyam Taluk. He further submitted that subsequently, a compromise was arrived between the aforesaid persons and some of the plots were allotted to the petitioner and the petitioner is in possession and enjoyment of the said plots and the facts remain so, the said Chandrasekar is trying to sell the plots which are in the possession and enjoyment of the petitioner and hence the petitioner has lodged a complaint before the second respondent on 06.11.2017, but, so far no action has been taken. https://hcservices.ecourts.gov.in/hcservices/ 3.The learned Government Advocate (Crl.Side) has submitted that after receipt of the complaint, the petitioner was called upon for
enquiry, but he has not turned up and hence the enquiry is still pending.
4.Recording the aforesaid submissions, the petitioner is directed to appear before the second respondent on 05.02.2018. On such appearance the second respondent has to conduct the enquiry and if the enquiry reveals any cognizable offence, then he has to register a case and proceed further in accordance with law. In case the petitioner failed to appear on that date, it is open to the second respondent to drop further proceedings. 5.With the aforesaid observations, this Criminal Original Petition is disposed of.
