Side) ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 294(b), 506(ii), 498(A) of the Indian Penal Code and Section 4 of the Dowry Prohibition Act in Crime No.12 of 2014 on the file of the respondent police, seek anticipatory bail.

2. This Court, by order dated 22.07.2014, granted interim Anticipatory Bail to the petitioners herein and directed the parties to appear before the Mediation and Conciliation Centre, attached to this Bench.

3. By virtue of the said interim order, the parties appeared before the Mediation Centre and arrived at an amicable settlement. The Mediation Centre forwarded a report dated 22.09.2014, wherein it has been stated that both the parties agreed not to proceed further H.M.O.P.No,.41 of 2014, pending on the file of the Sub Court, Theni. https://hcservices.ecourts.gov.in/hcservices/ It has also been stated that the de facto complainant totally

received a sum of Rs.1,60,000/- from the petitioner/accused. It is further stated that the criminal case filed against the petitioner/accused in Crime No.12 of 2014 on the file of the All Women Police Station, Nilakottai has been withdrawn by the de facto complainant.

4. Under such circumstances, the interim Anticipatory Bail granted by this Court on 22.07.2014 is made absolute, subject to the following conditions:- [a]. the petitioners shall report before the respondent police as and when required for interrogation.

[b].the petitioners shall not tamper with evidence or witness either during investigation or trial.

[c].the petitioners shall not abscond either during investigation or trial.

[d].On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioners released on bail by the learned Judicial Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005) AIR SCW 5560].
