P RAYER : Petition filed under Article 226 of the Constitution of India, to issue of Writ of Mandamus, directing the respondents 1 to 4 to pass suitable orders so as to dismantle and remove the dangerous and dilapidated non-functional mobile tower of the 5th respondent situate in the lands of the petitioner comprised in Survey No.96/2A2, Arasur Village, Sathankulam Taluk, Thoothukudi District, which is endangered to the lives and properties nearby by considering the representation of the petitioner dated 24.06.2024 within a time frame as may be fixed by this Court.

ORDER

This writ petition has been filed seeking for a mandamus, directing the respondents 1 to 4 to pass suitable orders so as to dismantle and remove the dangerous and dilapidated non-functional mobile tower of the fifth respondent situate in the lands of the petitioner comprised in Survey No.96/2A2, Arasur Village, Sathankulam Taluk, Thoothukudi 2/4

District, which is endangered to the lives and properties nearby by considering the representation of the petitioner dated 24.06.2024.

2. Heard the learned counsel appearing on either side and perused the materials placed before this Court.

3. Without expressing any opinion on merits of the writ petition, the third respondent is directed to issue notice to the petitioner as well as the fifth respondent and conduct enquiry on the request made by the petitioner, after hearing both sides, pass orders on merits and in accordance with law, within a period of six (6) weeks from the date of receipt of a copy of this order.

4. With the above direction, the writ petition stands disposed of. No costs.
