ORDER : The Court Made the following order :- The petitioner, who is arrayed as A-1 in Crime No.79 of 2015 on the file of the respondent police, was arrested and remanded to judicial custody on 11.06.2015 for the alleged commission of offence under Section 174(3)(i) of Cr.P.C @ 304(B) of I.P.C and hence seeks bail.

2. The case of the prosecution is that the daughter of the defacto complainant died by consuming poison due to dowry harassment of the accused.

3. The learned counsel for the petitioner submitted that the defacto complainant had earlier married one Selvi and through her, he is having three children and after divorcing the first wife, he married one Malar as second wife and there was frequent quarrel between the daughters of the first wife and the step mother and due to the constant quarrel, she developed depression and committed suicide.

4. It is further submitted by the learned counsel for the petitioner that the petitioner has been in judicial custody for more than 45 days and the accused Nos.2 and 3 were granted bail by this Court.

5. The learned Government Advocate(Crl. Side) submitted that the report of the Revenue Divisional Officer shows that the deceased

died due to dowry demand and major part of the investigation is over.

6.Considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail on the following conditions. Accordingly, the petitioner is directed to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Nilakkottai, Dindigul District and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., until further orders.
