PRAYER: Criminal Original Petition filed under Section 438 of Cr.P.C, praying for anticipatory bail to the petitioner in Crime No.134 of 2022.

ORDER
The petitioner, who apprehends arrest at the hands of the respondent Police for the offences punishable under Sections 109, 147, 148, 294(b), 323, 324, 302 and 506(ii) IPC in Crime No.134 of 2022 on the file of the respondent Police, seeks anticipatory bail. 2.The case of the prosecution, as per the de-facto complainant is that due to property dispute, the petitioner along with other accused and two other persons attacked his father, namely Mokkadurai and later, his father succumbed to injuries. Hence, the complaint. 3.The learned Counsel for the petitioner would submit that when the petitioner tried to pacify wordy quarrel between few persons, he has been falsely implicated in this case. He would also submit that the accused 1,2 and 4 have been arrested and subsequently enlarged on bail by the Sessions Court and the 5th accused was granted bail by this Court. He prays for grant of anticipatory bail to the petitioner.
4.The learned Government Advocate (Crl.side) would submit that this is third anticipatory bail application and earlier two applications were dismissed by this Court on 20.11.2022 and 23.12.2022 respectively and there is no change of circumstances. CRL.O.P(MD)No.1057 of 2023 5.Taking into consideration the fact the earlier two applications filed by the petitioner were dismissed and thereafter, there is no change of circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, this petition is dismissed.
