RESPONDENT/RESPONDENT/RESPONDENT Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to relax the condition to appear before the respondent police daily at 10.30am., imposed upon me in Crl.MP(MD)No.14401 of 2022 in Crl.A(MD) No.802 of 2022 dated 23.11.2022 by this Hon'ble Court. Prayer in CRL A(MD) No.802 of 2022 :

To calling for the records pertaining to the conviction and sentence passed in Spl.S.C.No.86 of 2018 on the file of the learned Sessions Court, Special Court for the Exclusive Trial of POCSO Act Cases, Madurai, dated 07.11.2022 and set aside the same as illegal and acquit the appellant.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.SIVABALAN K, Advocate for the petitioner and of MR.M.SAKTHI KUMAR, Government Advocate (Criminal Side)on behalf of the Respondent,the court made the following order:- This Criminal Miscellaneous Petition has been filed to relax the condition imposed on the petitioner on 23.11.2022 in Crl.M.P(MD) No.14401 of 2022 in Crl.A(MD)No.802 of 2022.

2. On the side of the petitioner, it is stated that the petitioner has been complying the condition regularly and he prayed for relaxation of the said condition.

CRL MP(MD) No.1532 of 2023 3.The learned Government Advocate (Crl. Side) would submit that after filing this relaxation petition, the petitioner did not comply the above said condition. Without complying the said condition, the relaxation petition is not at all maintainable. 4.Considering the submission of the learned Government Advocate (Crl. Side) this Criminal Miscellaneous Petition is dismissed and the petitioner is directed to comply the above said condition strictly for about one month from the date of receipt of copy of this order.
