ORDER

The Criminal Original Petition is filed to quash the charge sheet in C.C.No.566 of 2013 on the file of the learned Judicial Magistrate No.2, Madurai.

2.Heard Mr.M.M.Jegadeesh Pandian, learned Counsel for the petitioners and Mr.A.Ramar, learned Additional Public Prosecutor, who takes notice for the first respondent.

3.The learned Counsel for the petitioners stated that the case in C.C.No.566 of 2013 is now pending before the learned Judicial Magistrate No.5, Madurai and further stated that the petitioners will be satisfied, if a direction is issued to the lower Court to expedite the trial and dispose of the proceedings within the time fixed by this Court.

4.Having regard to the nature of allegations made in the complaint and factual controversies, which can only be resolved by the trial Court, this Court is inclined to issue the following directions:

"The learned Judicial Magistrate No.5, is directed to expedite the trial and dispose of the case in C.C.No.556 of 2013 within a period of four months from the date of receipt of a copy of this order"

5.The learned Counsel for the petitioners seeks indulgence of this Court to dispense with the presence of the petitioners 2 to 5, before the lower Court. Considering the facts and circumstances of the case and the fact that the petitioners 2 to 5 are women, the appearance of petitioners 2 to 5 before the lower court is dispensed with, unless and until their appearance is specifically required by an order of Court.

6.With the above observation, the Criminal Original Petition is disposed of. Consequently, the connected miscellaneous petitions are closed.
