O R D E R

This criminal original petition is filed by the petitioner to direct the respondent to file the final report on completion of the investigation in Page No. 1 of 4

Crime No.17 of 2010 dated 24.03.2010.

2. According to the petitioner, he is the defacto complaint in this case and already he filed a complaint as against the accused for the encumbrance created by the accused in respect of the family property of the petitioner. Thereafter, he filed a petition under Section 156(3) of Cr.P.C. before the Judicial Magistrate No.II, Dindigul in Crl.M.P.No.4772 of 2009 and based on the direction, the respondent police registered a case in Crime No.17 of 2010 for the offence under Sections 120(b), 468, 471 and 420 of I.P.C dated 24.03.2010. But so far, no proper investigation was conducted and filed any charge sheet. Therefore, he filed this petition.

The learned Government Advocate (Criminal Side) appearing for the respondent would submit that initially the case was registered by the District Crime Branch, Dindigul and it was transferred to the jurisdictional police station I.e the Inspector of Police, Dindigul Taluk Police Station on 22.07.2010. Thereafter, again this case was transferred to Thadikombu police station on 25.08.2010 for investigation and still the investigation is pending. To that effect, the Deputy Superintendent of Page No. 2 of 4

Police, District Crime Branch has filed a status report.

4. Heard both sides and perused the records.

5. This Court perused the status report and not satisfied with the status report of the respondent. The case is pending from 2009 without any progress, hence this Court directs the Deputy Superintendent of Police (Rural), Dindigul to take up the investigation and complete the investigation within three months from the date of this Order.

6. With the above said direction, this Criminal Original Petition is disposed of. No costs.
