This writ petition has been filed seeking the issuance of a writ of mandamus, directing respondents 1 to 3 to issue patta in favour of the petitioner in respect of Survey No. 275/13, situated at Nattumangalam Village, Ettiyathali Revenue Village, Aranthangi Taluk, Pudukkottai District, by cancelling the patta issued in favour of the fourth respondent, based on the petitioner's representation dated 22.02.2023.
2. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing on behalf of the respondent.
3. The petitioner submitted a representation dated 22.02.2023 seeking issuance of patta in his name in respect of the aforesaid properties. However, no action has been taken on the said application. Hence, the present writ petition has been filed. 2/5
4. Learned Additional Government Pleader, appearing on behalf of the respondent, submits that the petitioner's representation would be considered on merits and in accordance with law.
5. In view of the above submissions, without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the third respondent to consider the petitioner's representation dated 22.02.2023 on merits and in accordance with law and to pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order.
6. Such representation shall be considered and disposed of after conducting an inquiry. The third respondent is further directed to afford a reasonable opportunity to the petitioner, the fourth respondent and to all other persons who may be affected by such decision during the course of the inquiry.
