O R D E R

This petition has been filed to direct the second respondent to register a case, based upon the complaint given by the petitioner, dated 08.01.2018.

2. The learned counsel appearing for the petitioner has submitted that one Hari gave a false promise stating that he will make arrangement for getting job in Australia and believing his words, the petitioner has paid a sum of Rs.3,00,000/- to the said Hari and subsequently, he did not make any arrangement for getting job and also refused to return the amount and hence, the petitioner has lodged a complaint before the second respondent on 12.10.2017 and based on the said complaint, the second respondent has conducted an enquiry and during the said enquiry, the said Hari gave an undertaking that he will repay the amount of Rs.3,00,000/- on or before 28.10.2017, but, he has returned only a sum of Rs.1,00,000/- and thereafter, he did not repay the balance amount of Rs.2,00,000/- and hence, the petitioner has lodged https://hcservices.ecourts.gov.in/hcservices/

another complaint on 08.01.2018, but, so far, no action has been taken on the said complaint.

3. The learned Government Advocate (Crl. Side) appearing for the respondents has submitted that the enquiry is still pending.

4. Considering the aforesaid submissions, the second respondent is directed to expedite the enquiry and if the enquiry reveals any cognizable offence, then, he has to register a case and proceed in accordance with law.

5. with the aforesaid observations, the Criminal Original Petition is disposed of.
