Prayer :- Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorarified Mandamus to call for the records pertaining to the impugned letter of the 3rd respondent in X.K.vz;.33930/2019/G5 dated 19.11.2019 and quash the same as illegal and consequently direct the 4th respondent to issue patta in favour of the petitioner in respect of Survey No.84/1B, Sathamangalam Village, Madurai North Taluk, Madurai.

ORDER

This writ petition is filed to issue Writ of Certiorarified Mandamus to quash the impugned letter of the third respondent in X.K.vz;.33930/2019/G5, dated 19.11.2019 and consequently direct the fourth respondent to issue patta in favour of the petitioner in respect of Survey No.84/1B, Sathamangalam Village, Madurai North Taluk,

In the impugned order, reference is made to S.No.84/1A1 of Sathamangalam Village, Madurai North Taluk, Madurai District, whereas the petitioner's property is situated in S.No.84/1B of the same village. Therefore, there is a non-application of mind on the part of the third respondent, who followed the report of the fourth respondent where once again reference is made to S.No.84/1A1. Therefore, this writ petition is allowed and the matter is remitted back to the fourth respondent for passing necessary orders in respect of the petitioner's request for issuing patta in respect of the property situates in S.No.84/1B, Sathamangalam Village, Madurai North Taluk, Madurai within a period of six weeks from the date of receipt of a copy of this order.
