Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondents herein to provide alternate temporary shops with basic facilities to conduct business at Jawahar Thidal (Groud) and at Old Police Quarters for all the existing lessees of 540 shops of Mahatma Gandhi Daily Market, Palayamkottai, Tirunelveli District, as per their commitments and directions of this Court made in W.P(MD)No.14700 of 2021 by considering the petitioner's representation dated 29.12.2021. ORDER
The present writ petition has been filed by the President of the Gandhi Market Vendors United Association seeking a mandamus directing the respondents to provide alternative temporary shops to enable all the existing licensees of 540 shops in the Mahatma Gandhi Daily Market, Palayamkottai, Tirunelveli District to conduct business. 2/5
2.According to the learned counsel appearing for the writ petitioner, under the smart city project, Tirunelveli Corporation proposed to demolish all the old shops and construct new ones. During the intervening period, alternative temporary shops were required to be provided to all the shop owners. However, they have not done so. Hence, the present writ petition.
3.The learned Special Government Pleader appearing for the respondents 2 and 3 brought to the notice of the Court that the construction of the new shops has been completed, they have been opened and all the members of the association have been accommodated therein. The temporary shops have been vacated. The area in which the temporary shops were located belong to different departments, and steps are being taken to hand over the same to the concerned departments. In view of the above submission, nothing survives to be adjudicated. 3/5
