ORDER

The writ petition has been filed seeking issuance of a Writ of Mandamus, directing the third respondent to implement the communication sent by the second respondent dated 04.12.2025 in Oo.Mu.L2/7497/2025, based on the petitioner's representation dated 20.11.2025.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel appearing for the petitioner would submit that the petitioner is the absolute owner of the property comprised in Survey Nos.333/5A, 333/6A, 333/9A, and 333/7A at Pazhavoor Village, Tirunelveli Taluk, Tirunelveli District, assigned under the Tamil Nadu Land Reforms Scheme vide F-Patta dated 16.12.1987, and has been in peaceful possession thereof. An error in the F-Patta incorrectly recorded Survey No.333/7A as 337/7A, which was rectified by the Assistant Commissioner (Land Reforms) on 17.02.1995. Computerized pattas were issued in favour of the petitioner for Survey Nos.333/5A, 333/6A, and 333/9A. However, a patta for Survey No.333/7A was erroneously issued in favour

of one Maheswari, W/o.Balasubramanian, who has no lawful right or title to the property. Therefore, the petitioner submitted a representation on 20.11.2025 seeking cancellation of the patta issued to Maheswari. The second respondent directed the third respondent to enquire into the matter and take appropriate action vide communication dated 04.12.2025. However, no action has been taken, and the petitioner has filed the present writ petition seeking appropriate directions for cancellation of the erroneous patta and recognition of his ownership.

4. The learned Government Advocate appearing for the respondents would submit that the petitioner's representation will be considered and appropriate orders will be passed in accordance with law, within a time frame to be fixed by this Court.

5. Recording the above submissions, this Writ Petition is disposed of, with a direction to the third respondent to consider the representation of the petitioner, dated 20.11.2025, on merits and pass appropriate orders in accordance with law, after giving due opportunity to the petitioner and all other persons, who may be interested in the subject matter, within a period of sixteen weeks from the date of

receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the third respondent to consider the same on its own merits. There shall be no order as to costs.
