PRAYER IN CRL OP(MD).No.6060 of 2019:- Criminal Original Petition filed under section 482 of Cr.P.C., to set aside the order passed by the lower court in Crl MP.No.288 of 2019 in C.C.No.11 of 2017 dated on 26.03.2019 on the file of the Additional Chief Judicial Magistrate, kumbakonam for the reasons stated and to relax the condition imposed by Additional Chief Judicial Magistrate, Kumbakonam in Crime No.114 of 2005. ORDER:- This Criminal Miscellaneous Petition coming on for hearing on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.S.RAMASAMY, Advocate for the Petitioner and of MS.M.ANANDADEVI, Government Advocate (CRL SIDE) for the respondent, this Court made the following order:

This petition has been filed to relax the condition imposed on the petitioner in Crl.O.P(MD)No.6060 of 2019.

2. The learned counsel for the petitioner would submit that the petitioner is a diabetic patient and he is unable to travel from Chennai to Palavoor police station. Hence he seeks modification.

3. The learned Government Advocate (Crl. Side) would submit that the petitioner is the former Investigating Officer and he is involved in idol theft cases and if the condition is fully relaxed he will abscond, hence she opposed for modifying the said condition.

Taking into consideration the submissions made by both sides, the condition imposed by this court in Crl.O.P(MD)No.6060 of 2019 on 27.04.2019 is modified to the effect that the petitioner shall report before the Idol Wing Police Station, Guindy at Chennai daily at 10.30 a.m until further orders.
