Respondents Prayer: This Criminal Original petition is filed under Section 482 of Code of Criminal Procedure, to direct the respondents 1 and 2 herein to file final report in respect of the case in Crime No.297 of 2016 under Sections 294(b), 323, 506(i) of IPC on 27.07.2016 and the damaged properties and other things of the petitioner which is pending on the file of the respondents 1 and 2 herein or any other police officer.

This petition has been filed to direct the second respondent to file a final report in Crime No.297 of 2016, within the time that may be fixed by this Court.

2. The learned counsel appearing for the petitioner has submitted that the petitioner gave a complaint stating that the accused persons have committed offences under Sections 294(b), 323, 506(i) of IPC and the case was registered by the respondent police in Crime No.297 of 2016, but, so far, no final report has been filed.

3. The learned Government Advocate (Crl. Side) appearing for the respondent has submitted that after investigation the matter has been referred as "Mistake of Fact" on 27.07.2016 itself and the said report has been filed before the concerned Jurisdictional Magistrate, after giving notice to the petitioner.
