PRAYER :- For Bail in Crime No. 02 of 2022 on the file of the Respondent police.
ORDER : The Court made the following order :- The petitioner, who was arrested on 02.01.2022 for the alleged offence under Sections 147, 148, 341, 294(b), 307, 323, 363 and 506(ii) of IPC, in Crime No.2 of 2022, on the file of the respondent police, seeks bail.
2.The case against the petitioner is that on 01.01.2022 at about 7 p.m., the petitioner along with other accused waylaid the defacto complainant and attacked him and caused injuries to him. 3.On the side of the petitioner, it is stated that the petitioner is a college going student, studying B.A English and also stated that no previous case is pending against him. It is also stated that the injured has been treated as out patient and the petitioner was arrested and remanded to judicial custody on 02.01.2022. Hence, he prays for grant of bail. 4.On the side of the prosecution, it is stated that totally 6 accused involved in the offence, the petitioner is arrayed as A2. CRL OP(MD). No.952 of 2022 complainant and try to murder him. The specific overt act against the petitioner is that he caused head injuries to the defacto complainant. It is also stated that the petitioner is having three previous cases and prayed the petition to be dismissed.
5. Considering the previous antecedent of the petitioner and considering the nature of the offence committed by this petitioner, this Court is not inclined to grant bail to the petitioner.
