ORDER : The Court made the following order :- The petitioner/A2 who apprehends arrest at the hands of the respondent police for the offences punishable under sections 465,468,471,166,216,506(i) of I.P.C., in Crime No.40 of 2021 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution as per the de-facto complainant is that the petitioner who is Zonal Deputy Tahsildhar, Koolpandi, Madurai North Circle had issued fraudulent patta in favour of the co accused without verifying any documents, hence the complaint.

3. Heard. Perused the materials available on record including the First Information Report.

4. It is seen that the petitioner is working as Tahsildhar and he used to issue patta for un-occupied land of others without any valid documents. IN the present case he issued patta in favour of A1 https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD). No.1206 of 2022 in respect of the subject property.. The subject property was purchased by a retired employee by his hard earned money. Pending anticipatory bail this Court had called for report from the Revenue Divisional Officer, Madurai, whether any such patta was issued for any document or production of any fraudulent documents. The Revenue Divisional Officer had produced a report before this court dated 28.03.2022 wherein he has stated that the above patta No.2638 for land in Resurvey No.59/8N-0.09.0 ares in Anaiyur I bit Village, Madurai North Taluk by transferring the patta on the application submitted by the first accused. The petitioner herein without even conducting any enquiry with the rival parties mechanically on receipt of some documents form the first accused had transferred the patta in his favour.

Subsequently on enquiry the RDO had cancelled the patta in favour of the first accused. That apart the petitioner already involved in a case in Crime No.27 of 2021 on the file of the Inspector of Police, City Crime Branch, Madurai for similar offence. Further the petitioner is responsible for issuance of patta for unoccupied lands, therefore custodial interrogation of the petitioner is very much required in this case, hence this Court is not inclined to grant anticipatory bail to the petitioner.

5. Hence the petition stands dismissed.
