ORDER

The present Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents 3 and 4 to issue a Patta based on the order passed by the second respondent in his proceedings in Ni.Mu. (D6)/1052160/2022, dated 16.10.2025, within a time frame to be fixed by this Court.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel for the petitioner submits that the petitioner and his family members have been in peaceful possession and enjoyment of the property in question. A series of representations were made to the respondents seeking issuance of Patta, but despite repeated requests, the respondents have not considered the same. Hence, the petitioner filed W.P.(MD)No.12834 of 2024, and

this Court, by order dated 18.06.2024, disposed of the said writ petition, directing the second respondent to pass final orders on the petitioner's representation. Pursuant to the order passed by this Court, the second respondent passed an order in proceedings dated 16.10.2025, sub-dividing S.No.402/1 into S.Nos.402/7, 402/8, and 402/9, and directed the fourth respondent to issue Patta for S.No.402/9 to the petitioner and others. Subsequently, the petitioner made a representation to the respondents on 31.10.2025, requesting issuance of Patta. Since this representation has not been considered till date, the petitioner has now approached this Court by filing the present Writ Petition.

4. The learned Additional Government Pleader appearing for the respondents submits that the petitioner's representation will be considered and appropriate orders will be passed in accordance with law, within a time frame to be fixed by this Court.

Recording the above submissions, this Writ Petition is disposed of, with a direction to the respondents 3 and 4 to consider the representation of the petitioner, dated 31.10.2025, on merits and pass appropriate orders in accordance with law based on the proceedings of the second respondent, dated 16.10.2025,

after giving due opportunity to the petitioner, and all other persons, who may be interested in the subject matter, within a period of twelve weeks from the date of receipt of a copy of this order. It is also made clear that this Court has not expressed any of its views with regard to the merits of the matter and that it is open to the respondents 3 and 4 to consider the same on its own merits. Needless to state that in the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court. There shall be no order as to costs.
