O R D E R
This petition has been filed to direct the second respondent to register a case, based upon the complaint given by the petitioner, dated 28.12.2017.
2. The learned counsel appearing for the petitioner has submitted that the petitioner has entered a sale agreement with the proposed accused for purchasing the property for Rs.5,00,000/- and in pursuance of the said agreement, the petitioner has paid a sum of Rs.5,00,000/-, but, thereafter, the proposed accused has not come forward for executing a sale deed and hence, the petitioner has made demand with the proposed accused to execute a sale deed and aggrieved by the same, the proposed accused criminally intimidated the petitioner and also cheated the petitioner and hence, the petitioner has lodged a complaint before the second respondent on 28.12.2017, but, so far, no action has been taken. https://hcservices.ecourts.gov.in/hcservices/
3. The learned Government Advocate (Crl. Side) appearing for the respondents has submitted that the enquiry is still pending.
4. Considering the aforesaid submissions, the second respondent is directed to expedite the enquiry and if the enquiry reveals any cognizable offence, then, he has has to register a case and proceed in accordance with law.
5. With the aforesaid observations, the Criminal Original Petition is disposed of.
