PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari to call for the records pertaining to the impugned order passed by the 1st respondent in his proceedings dated 12.12.2024 in Letter Ref.No.SCN/320243433/24 and his subsequent proceedings dated 25.11.2025 in Letter Ref.No.REM/1052427647/25 and quash the same as illegal. 1/4

ORDER

The present writ petition has been filed seeking to quash the order passed by the first respondent wherein a show cause notice issued to the petitioner why his passport should not be impounded.

According to the learned Government Advocate(crl.side) appearing for the second respondent, the petitioner has been implicated in a criminal case in Cr.No.864 of 2015 on the file of the second respondent on the basis of a complaint lodged by the Indian High Commission, Maldives, which has culminated in filing of a charge sheet before the learned Judicial Magistrate No.II, Tiruchirapalli, on 27.01.2026.

3. The learned Counsel appearing for the petitioner submits that the petitioner is holding a passport which is valid up to 28.11.2024. However, the 2/4

present impugned show cause notice has been issued to impound the passport on the ground that the petitioner has suppressed about the pendency of the criminal case as against him.

Considering the fact that already charge sheet has been laid before the learned Judicial Magistrate No.II, Tiruchirappalli, the petitioner is directed to approach the concerned Court seeking permission of the court to go abroad. In case if any such application is filed, the same shall be disposed of within a period of 4(four) weeks. Based upon the orders to be passed by the concerned trial Court, the first respondent is directed to proceed in accordance with law. In case, if the charge sheet has been laid and there is a delay on the part of the trial Court to take cognizance, the petitioner is at liberty to approach this Court again.

5. With the above said observations, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is also closed. 28.01.2026 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 3/4
