ORDER : The Court made the following order :- The petitioner, who apprehends arrest by the Respondent police in pursuant to the N.B.W. issued by 1/4

the Learned Principal Sessions Judge for EC and NDPS Act Cases, Madurai, in C.C.No.548/2023 for the alleged offences u/s. 8(c), 20(b)(ii)(B) of NDPS Act, as against the Petitioner, seeks anticipatory bail.

2. The learned counsel for the petitioner submitted that the petitioner was not able to attend for one hearing. Hence, NBW was issued by the trial Court. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner.

3. The learned Government Advocate(Crl. Side) submitted that it is a case of jumped out bail. Therefore, this Court cannot grant of anticipatory bail to the petitioner.

4. Considering the facts and circumstances of the case and also the fact that it is a case of jumped out bail, the petitioner is directed to surrender before the trial Court and file a recall 2/4

petition. On such filing of recall petition, the learned Magistrate is directed to consider the recall petition on the same day.

5. With the above direction, this Criminal Original Petition is disposed of.
