ORDER

This Writ Petition is filed seeking a Writ of Mandamus, directing the respondents 1 and 2 to survey and demarcate the property comprised in Survey No.529/23, measuring an extent of 2.22 cents and Survey No.529/10, measuring an extent of 2.47 cents, situated at Arunalanthapuram, Sudiyoor Post, Paramakudi, Ramanathapuram District, based on the petitioner's online

application dated 11.06.2025, enabling to fence the same with sufficient protection, since the sixth respondent is continuously disturbing and breaking the boundary stones.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. Since no adverse orders are going to be passed against the sixth respondent, notice to the sixth respondent is hereby dispensed with.

4. The learned counsel for the petitioner would submit that the petitioner is the absolute owner of the subject properties and is in peaceful possession and enjoyment of the same. It is further submitted that the petitioner made an application dated 11.06.2025 before the competent authority, seeking survey and fixation of boundaries in respect of the said properties. Despite receipt of the said representation, no further effective steps have been taken by the authorities. Hence, the petitioner has been constrained to file the present Writ Petition seeking appropriate directions to enable the authorities to conduct the survey and fix the boundaries.

5. The learned Additional Government Pleader appearing for the respondents 1 to 3 would submit that proper steps would be taken to survey and demarcate the lands in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923.

Recording the aforesaid submission, this Court directs the respondents to consider the petitioner's application dated 11.06.2025 and demarcate the subject properties, after considering the claims of the petitioner, the sixth respondent and any other rival parties, if any, and to pass orders in accordance with Sections 9 and 10 of the Tamil Nadu Survey and Boundaries Act, 1923, within a period of twelve weeks from the date of receipt of a copy of this order. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court.

7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
