ORDER

The present writ petition has been filed seeking to quash the order passed by the fourth respondent herein wherein the request of the petitioner to alter her name and date of birth in the transfer certificate issued by the fifth respondent has been rejected.

2.A perusal of the records reveal that the petitioner had studied from Ist standard to Vth standard in the fifth respondent School and she was issued with a transfer certificate wherein the name of the petitioner is 2/6

incorporated as Seelaikari and date of birth is mentioned as 02.04.1980. However, VIII mark statement of the petitioner reflects the date of birth of the petitioner as 01.01.1978 and the name of the petitioner as Sheeladevi. All other official records reflect that the date of birth as 01.01.1978 and name of the petitioner as Sheeladevi.

3.The petitioner had discontinued her regular studies from the School in the IV standard and all other higher education has been studied through private system. Therefore, this is the only transfer certificate available with the petitioner. Since the name and date of birth are different, the petitioner has approached the fourth respondent. The fourth respondent has rejected the same on the ground that they were not able to trace the records. 4.Heard both sides and perused the material records. 5.The birth certificate issued to the writ petitioner, VIII mark statement, Community Certificate, Aadhar Card, Family Card and Legal Heir certificate of the petitioner clearly reflect the name of the petitioner as Sheeladevi and her date of birth is 01.01.1978.

6. In such circumstances, if the transfer certificate is not amended and a new certificate is issued, the petitioner is likely put to great prejudice. Therefore, the order impugned in the writ petition is set aside and the respondents 4 and 5 are directed to issue a fresh transfer certificate to the writ 3/6

petitioner incorporating the name of the petitioner as Sheeladevi and the date of birth as 01.01.1978. The said exercise shall be completed within a period of 8 weeks from the date of receipt of a copy of this order. 7.With the above said observations, this writ petition stands disposed of. No costs.
