ORDER

This Criminal Original Petition has been filed to transfer the investigation in Cr.No.46/2024 from the file of the 4th respondent police to 3rd respondent police.

2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent police. Perused the materials available on record.

3.The contention of the petitioner is that based on the complaint of the petitioner, who is a depositor, a case in Cr.No. 46 of 2024 was registered for the offence punishable under Sections 120(B), 406, 420 IPC and Sections 3 and 5 of TNPID Act has been registered against the accused persons. In this case, though several crores have been cheated by the accused persons, the respondent police is not showing any interest to collect the details from all the depositors by giving wide publicity in the media. Hence, this petition has been filed. 4.The learned Additional Public Prosecutor submitted that in this case after registration of case, wide publicity has been given in 2/5

printing and visual mode. So far, the respondent police has received complaint to the tune of Rs.50 lakhs. If the complaint is received for more than Rs.3 crores, then the complaint will be forwarded to the 3rd respondent for investigation. The investigation is proceeding in a right direction.

5.In view of the above, this Court direct the 4th respondent police to continue with the investigation and conclude the same without any delay. The Assistant Commissioner of police, City Crime Branch is directed to monitor the investigation conducted by the 4th respondent police.

6.With the above directions, the petition stands disposed of. 22.01.2025 NCC : Yes/No Index : Yes / No Internet : Yes / No PNM 3/5
