the order dated 22.07.2020 passed by the second respondent be kept in abeyance.

ORDER

The coconut trees belonging to the petitioner are protruding the adjacent land and has been affecting the petitioner's neighbor/ fourth respondent from putting construction and therefore, the fourth respondent has approached the second respondent by way of a representation in the year 2020. The second respondent by his proceedings dated 22.07.2020, directed the petitioner to remove the coconut tree, which is obstructing the construction of the fourth respondent. As against this order dated, 22.07.2020, the petitioner claims that he has filed an appeal before the District Revenue Officer, Madurai and the same is pending. In the 2/6

meantime, the fourth respondent said to have filed a writ petition before this Court in WP.(MD)No.16916 of 2024 and the same is pending. Therefore, the third respondent, by referring to the earlier proceeding dated 22.07.2020, directed the petitioner to remove the coconut tree as directed by the second respondent, on or before 14.01.2026. Aggrieved by the same, the petitioner has preferred this writ petition.

2.M/s.S.Jeyapriya, learned Government Advocate takes notice for the respondents 1 to 3 and submits that the appeal preferred by the petitioner is pending before the District Revenue Officer, Madurai.

3.The petitioner, who is not able to get any interim orders from the District Revenue Officer, has approached this Court by way of this writ petition. Since the appeal preferred by the petitioner is pending from the year 2020, the District Revenue Officer, Madurai is directed to dispose of the appeal, within a 3/6

period of two weeks from the date of receipt of a copy of this order. Till such time the order passed by the second respondent is kept under abeyance. The petitioner is expected to co-operate before the District Revenue Officer, Madurai. The petitioner is bound by the orders to be passed by the District Revenue Officer, 4.With the above directions, this writ petition is disposed of. No costs.
