Respondents PRAYER: Petition filed under Article 226 of the Constitution of India to issue a writ of Habeas Corpus, directing the 1st and 2nd respondents to produce the body or person of the detenu, who is the petitioner's daughter, namely, Hemalatha, D/o Ranjithkumar, aged about 21 years, before this Court and set her at liberty.

It is stated that the daughter of the petitioner went missing on 30.08.2023 from the home. Hence, a complaint was given by the petitioner to the second respondent and it was registered in Crime No.389 of 2023. As per the complaint, the daughter of the petitioner was married to one Ashokkumar in the year 2022 and they are living happily for some time. In the said circumstances, she came to the parental house for Deepavali, but, she did not go back to her matrimonial home. In the said circumstances, she went missing on 30.08.2023.

2. On registration of the complaint, the police had made efforts and traced the lady. In the meantime, on information, the daughter of the petitioner, aged about 22 years, has been traced near Chennai serving as a Nurse in a private hospital.

3. Today, the lady was produced before this Court and she has given a letter in writing that her marriage with the said Ashokkumar was against her consent and by compulsion of her parents, she was forced to marry him. Not being interested to continue her marital life with the said Ashokkumar, she has left home on her own. The girl, who is present, confirms the said contend of the letter.

4. In the light of the above fact, nothing survives in this habeas corpus petition. Hence, this Habeas Corpus Petition is dismissed. (G.J.,J.) (C.K.,J.) 15.03.2024 NCC : Yes / No Index : Yes / No Internet : Yes skn
