The petition is filed to withdraw the investigation pending before the second respondent in Cr.No.241 of 2013 and transfer it to the third respondent 2.The learned Government Advocate (Crl.side) for the respondents would submit that already investigation has been completed in crime No.241 of 2013 on the file of the 2nd respondent and the same has been referred as "Mistake of Fact" and hence, nothing survives in this petition.

3.Recording the said submission made by the learned Government Advocate (Crl.side), this criminal original petition is dismissed as infructuous.
