ORDER

This Criminal Original Petition is filed for a direction to consider the warrant re-call application of the petitioner in C.C.No.335 of 2009 on the file of the learned Judicial Magistrate No.II, Virudhunagar on the same day itself without surrender of the petitioner.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) for the respondent.

3. The petitioner is arrayed as accused No.1 in C.C.No.335 of 2009. Due to non-appearance, the petitioner has been issued Non-Bailable Warrant.

4. The learned counsel appearing for the petitioner submitted that the petitioner would co-operate with the trial and appear before the trial Court regularly.

5. Considering the facts and circumstances of the case, a direction is issued to the learned Judicial Magistrate No.II, Virudhunagar to consider the warrant re-call application of the petitioner on merits and pass appropriate order on the same day.
