Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Certiorari calling for the records on the file of the 1st Respondent pertaining to the proceedings in I.D.No.57 of 2009 dated 26.07.2012 and quash the same and pass such further or other orders.

ORDER

This writ petition has been filed for issuance of a Writ of Certiorari to call for the records pertaining to the proceedings in I.D.No. 57 of 2009 dated 26.07.2012 on the file of the 1st Respondent and quash the same.

2. A batch of writ petitions in W.P.(MD)Nos.5, 6, 7, 9, 10, 12, 425 to 431, 1989 to 1994 of 2015 were filed by the workmen of the Transport Corporation as well as by the Transport Corporation questioning the similar awards passed by the first respondent/ Labour Court. The second respondent had filed W.P.(MD).No.430 of https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P(MD)No.6861 of 2013 2015 challenging the very same award. A learned Single Judge of this Court, by a common order dated 24.05.2017, has dismissed all the writ petitions filed by the very same petitioner/Transport Corporation and allowed all the writ petitions filed by the workmen, including the petitioner herein and thereby directed the Transport Corporation to accord permanency to the workmen from the date of completion of 240 days of their service in the light of 12

(3) settlement, dated 25.09.1989.

3. The issue involved in this writ petition has already been settled in the decision in W.P.(MD)Nos.5, 6, 7, 9, 10, 12, 425 to 431, 1989 to 1994 of 2015, by a common order dated 24.05.2017. Following the same, this Writ Petition is dismissed. No costs. Consequently, connected miscellaneous petition is also dismissed.
