In CRIMENO. NOT KNOWN OF 2018 ... RESPONDENT/RESPONDENT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to modify the conditions in Crl OP(MD)No.6710 of 2018 dated 26.04.2018.

Order :This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.K.SELVA GANESAN, Advocate for the petitioner and of MR.A.ROBINSON,Government Advocate(Crl.Side)on behalf of the Respondents the court made the following order:- The petitioner's counsel states that the petitioner was granted anticipatory bail on condition that he would remit a sum of Rs.20,000/- (Rupees Twenty Thousand only) per month in the Bank account of the defacto complainant. The petitioner has been complying the said condition till date. In the meanwhile, the petitioner had lost his earlier job and he is now in another employment with a lower salary.

The petitioner's counsel would point out that the petitioner is the only son of his parents, who are not having any other support, on the other hand, the father of the defacto complainant is a retired faculty of Madurai Kamaraj University and the mother of the defacto complainant is even now working as a Senior Professor in Thiagarajar Arts and Science College, Madurai. The defacto complainant is also M.Tech graduate and that she is said to be employed in Chennai. The petitioner however is not able to furnish the employment details of the defacto complainant.

2.The parties are not having any children , on this circumstance, I deem it fit and appropriate to modify the order dated 26.04.2018 and the petitioner is directed to deposit a sum of Rs.10,000/-(Rupees Ten Thousand only) per month henceforth. The petitioner through his counsel specifically undertakes that he would not come up for further modification till the marital proceedings between the parties are concluded.

3.With the above modification, this Criminal Miscellaneous Petition is allowed accordingly.
