In both Petitions, For Petitioner : Mr.S.Bharathy Kannan (Both Cases) For Respondent : Mr.Prabu Ramachandran (Both Cases) Government Advocate (Crl.Side) COMMON ORDER These Criminal Original Petitions have been filed by the petitioners, to direct the respondent not to harass the petitioners, based upon the complaint given by one G.Sathya @ G.Angel Sathya Jothi.
2.The learned counsel appearing for the petitioners has submitted that the said G.Sathya @ G.Angel Sathya Jothi, is the wife of the petitioner in Crl.O.P.(MD)No.1789 of 2018 and daughter in law of the petitioner in Crl.O.P(MD)No.1794 of 2018. developed illegal intimacy with one Vinish and after knowing the said fact, the petitioner in Crl.O.P(MD)No.1794 of 2018 has filed a divorce petition in H.M.O.P.No.12 of 2008, on the file of the Sub Court, Thanjavur and the same is still pending and that being so, the said G.Sathya @ G.Angel Sathya Jothi gave a false complaint before the respondent and the respondent is harassing the petitioners based on the said complaint.
3.The learned Government Advocate (Crl.Side) has submitted that after receipt of the complaint, C.S.R.No.134 of 2017 has been issued and the petitioners were called for enquiry by issuing summons, but the petitioners not appeared for enquiry and the enquiry is still pending.
4.Recording the aforesaid submissions, the respondent is directed to expedite the enquiry and if the enquiry reveals any cognizable offence, then he can register a case and proceed further in accordance with law. Under the guise of enquiry, the petitioners should not be subjected to any harassment. 5.With the aforesaid observations, these Criminal Original Petitions are disposed of.
