Prayer: Criminal Original petition is filed under Section 482 of Criminal Procedure Code, to direct the second respondent herein not to harass the petitioner under the guise of false complaint and except under process of law.

ORDER

This Criminal Original Petition has been filed by the petitioner, to direct the second respondent not to harass the petitioner, based upon the complaint given by the third respondent.

2.The learned counsel appearing for the petitioner has submitted that the petitioner has borrowed a sum of Rs.2.50 lakhs from one Manikandan and at that time, the petitioner has signed in blank pronote papers and also stamp papers and subsequently he has repaid the said amount. She further submitted that the third respondent, who is the real estate broker, he is in noway connected with the aforesaid transactions, gave a false complaint before the second respondent and based on the said compliant, the second respondent is harassing the petitioner. 3.The learned Government Advocate (Crl.Side) has submitted that the third respondent gave a complaint stating that the petitioner has received amount by giving false promise that he will make arrangement for job and hence the enquiry is still pending.

4.Considering the aforesaid submissions, the second respondent is directed to expedite the enquiry and if the enquiry reveals any cognizable offence, then he has to register a case and proceed further in accordance with law. During such enquiry, the petitioner should not be subjected to unnecessary harassment. 5.With the aforesaid observations, this Criminal Original Petition is disposed of.
