PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 1st respondent to issue passport to the Petitioner by considering his explanation dated 17.12.2025 within a period that may be fixed by this Court.

ORDER

The present writ petition has been filed seeking a mandamus directing the first respondent for re-issuance of the passport to the petitioner based upon his explanation submitted on 17.12.2025.

2. The learned Government Advocate(crl.side) appearing for the second respondent brought to the notice of the Court that the petitioner has been implicated in a criminal case in Cr.No.33 of 2024 on the file of second respondent herein which has culminated in filing of a charge sheet in S.T.C.No. 5 of 2026 on the file of Judicial Magistrate Court, Kariapatti, Virudhunagar District.

3. In view of the above said facts, the petitioner is directed to approach the trial Court concerned seeking permission of the Court to go abroad. In case if any such application is filed, the same shall be disposed of within a period of four weeks. Based upon the orders to be passed by the trial Court, the first respondent is directed to proceed in accordance with law.

4. With the above said observations, this writ petition stands disposed of. No costs.
