PRAYER IN CRL MP(MD)No.3492 of 2020 in CRL A (MD) No.495 of 2019: Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to suspend the sentence imposed by the conviction and sentence passed by the Learned Additional District Court(Fast Track), Theni in S.C.No.135/2016 dated 13/09/2019 against the petitioners and enlarge the petitioners on bail pending disposal of the main appeal. To call for the records and set aside the Judgment passed by the Learned Additional District Court(Fast Track), Theni in S.C.No.135/2016 dated 13.09.2019 and allows this appeal and acquits the Appellants/ Accused Nos.1 to 3.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.S.VANCHINATHAN, Advocate for the petitioners and of Mr.K.K.RAMAKRISHNAN,Additional Public Prosecutor on behalf of the Respondents, the court made the following order:- This petition has been filed to relax the condition imposed by this Court in Crl.M.P(MD)No.3492 of 2020 in Crl.A(MD)No.495 of 2019, dated 05.08.2020.
2.This Court while granting bail to the petitioners vide order, dated 05.08.2020 directed them to stay at Madurai and report before the Inspector of Police, Thallakulam Police Station, Madurai daily at 10.00 a.m., until further orders.
3.Mr.S.Vanchinathan, learned counsel appearing for the petitioners would state that both the petitioners are brothers and they are daily coolies and they have been complying with the condition of this Court from 28.08.2020 and they find it difficult to meet both the events on account of complying the conditions imposed on them.
4. Mr.K.K.Ramakrishnan, learned Additional Public Prosecutor appearing for the respondent has no serious objection for modifying the condition.
5.In the light of the above fact, the condition imposed on the petitioners to stay at Madurai and report before the Inspector of Police, Thallakulam Police Station, Madurai daily at 10.00 a.m., until further orders is modified to the effect that the petitioners shall appear before the committal Court on the first working day of every English Calender month at 10.30 a.m., until further orders. sd/- 04/02/2021 / TRUE COPY / / /2021 Sub-Assistant Registrar (C.S.)
