Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus to direct the respondent to consider and dispose of the petitioner's representation dated 09.10.2024 to appoint the petitioner on Compassionate grounds. ORDER

The instant writ petition has been filed by the wife of a deceased employee of the respondent transport corporation, seeking a mandamus to provide employment to her on compassionate grounds.

2. A perusal of the affidavit reveals that the petitioner's husband was working as an Assistant Tradesman in the respondent transport corporation and he was murdered on 20.01.2024 and a criminal case in Cr.No.38 of 2024 has been registered on the file of Eraniel Police Station, Kanyakumari District. The petitioner has also obtained a legal heirship certificate from the Revenue Department on 10.02.2024.

3. According to the learned counsel appearing for the petitioner, the petitioner has made a representation before the respondent on 09.10.2024, to appoint her on compassionate grounds. Since, the same has not been considered, the petitioner has filed the present writ petition. 2/4

4. The learned Standing Counsel appearing for the respondent submits that they are maintaining the seniority list for providing compassionate appointment and based upon the seniority, the request of the petitioner would be considered.

5. Considering the above said facts, the respondents are directed to consider the representation of the writ petitioner dated 09.10.2024 and pass appropriate orders based upon the seniority of the writ petitioner.

6. The writ petition is disposed of with the above observations and directions. No costs.
