O R D E R
(Order of the Court was made by G.K. ILANTHIRAIYAN,J.) This Habeas Corpus Petition has been filed for a direction directing the respondents 1 & 2 to secure and produce the detenu, before this Court.
2. The petitioner married the detenue and gave birth two children. They are major, aged about 20 years and 19 years. While being so, the petitioner's wife was missing from the matrimonial home from 27.12.2025. The petitioner also suspects the third respondent, who allegedly kidnapped the detenu. He lodged a complaint before the second respondent and the same has been registered in Cr.No.432 of 2025 under 'Woman Missing'.
3. The learned Additional Public Prosecutor appearing for the respondents 1 & 2 submitted that during the investigation, the second
respondent found that the petitioner's wife, aged about 41 years eloped with third respondent and their cell phones were switched off. Therefore, their whereabouts are not known sofar.
4. Admittedly, the petitioner's wife is aged about 41 years and she has illegal intimacy with the third respondent and eloped with him. In fact, two major children are very much available with the petitioner herein. Therefore, there is no question of illegal detention at the hands of the third respondent since the detenu is aged about 41 years and eloped with the third respondent on her own volition.
5. Accordingly, this Habeas Corpus Petition is not maintainable and it is dismissed. However, the petitioner is at liberty to approach the appropriate Court for appropriate relief. [G.K.I., J.] [R.P., J.] 21.01.2026 am NCC :Yes/No Index: Yes/No Internet: Yes/No
