ORDER
Seeking to direct the respondents 1 and 2 not to harass the petitioner at the instance of the third respondent, this criminal original petition is filed.
2.The learned counsel for the petitioner submitted that having borrowed an amount of Rs.5,24,000/- from the petitioner, the third respondent had lodged a complaint, in which, the second respondent police is subjecting the petitioner to harassment. 3.Per contra, the learned Government Advocate (Crl.side), on instructions, submitted that the petitioner is a money lender, from whom the third respondent had borrowed an amount of Rs.5,24,000/-, for which, the third respondent had pledged gold to the tune of 13.5 sovereigns with the petitioner for security purpose. In this regard, the 2/5
petitioner had duly appeared before the second respondent police for enquiry, during which time, he had agreed to permit the third respondent to redeem the pledged jewelry on payment of the borrowed money with interest. The third respondent is ready to make the repayment, for which, the petitioner is not amenable. However, at the time of enquiry, the petitioner had undertaken that if the borrowed amount is returned back with interest, she will return back the jewellery to the third respondent.The learned Government Advocate (Crl.side) also placed before me the statement given by the petitioner in her own handwriting.
4.Recording the same, I do not find any necessity to interfere with the ongoing enquiry before the second respondent. Accordingly, this Criminal Original Petition is closed.
