PRAYER :- For Anticipatory Bail in Crime No.176/2024 on the file of the respondent Police.

ORDER : The Court made the following order :- The petitioner apprehending arrest at the hands of the respondent police for the offences punishable under sections 294(B), 506(1) and 379 IPC and Section 4 TNPHW Act ( Corresponding BNS, 296, 351 and 303) in Crime No.176 of 2024 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that due to family dispute, the petitioner herein, who is the son of the defacto complainant had stolen the property documents and jewels from the house of the defacto complainant. When the same was questioned by the defacto complainant, the petitioner herein has harassed her and also abused her in filthy language. Hence, a case has been registered.

3. The learned counsel appearing for the petitioner submitted that the occurrence took place before 8 years, now, without any valid proof 2/6

the defacto complainant has given a complaint. He would further submit that the petitioner is innocent and his name has been falsely implicated in this case and also submitted that the petitioner is the son of the defacto complainant.

4. The learned Government Advocate (Crl. Side) appearing for the respondent police would submit the petitioner herein had stolen the jewels and property documents from the house of the defacto complainant and when the same was questioned by the defacto complainant he has harassed her and also abused in filthy language and hence, he strongly opposed to grant anticipatory bail to the petitioner.

Considering the facts and circumstances of the case and also the considering the relationship between the parties, this Court is inclined to grant anticipatory bail to the petitioner, subject to certain conditions. 6.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, on condition that the petitioner shall execute a separate bond for a sum of Rs.10,000/- (Rupees Ten 3/6

Thousand only) with two sureties, for a like sum to the satisfaction of the learned Judicial Magistrate, Uthamapalayam, within a period of fifteen days from the date on which, the order copy was made ready and on further conditions that:

[a]the petitioner and the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity; [b] the petitioner shall report before the respondent police daily at 10.30 a.m., for a period of two weeks and thereafter, as and when required for interrogation.

(c) The de facto complainant and one of the sisters of the petitioner are living in the same place. The petitioner shall not disturb the mother who is living there during her lifetime.

[d]the petitioner shall not tamper with the evidence or witness either during investigation or trial. [e]the petitioner shall not abscond either during investigation or trial.

[f]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
