ORDER

This Criminal Original Petition is filed seeking to direct the 3rd respondent to provide adequate police protection to the life and limb of the petitioner to erect fence by considering the petitioner's representation dated 11.11.2025.

2. Considering the relief to be granted by this Court, notice to the 4th respondent is dispensed with.

The learned counsel for the petitioner submitted that the 4th respondent is the petitioner's brother and already partition has been effected between the petitioner and her brother with respect to the petitioner's land. In this regard, the dispute ended in a scuffle between the 4th respondent and the petitioner. Earlier, on 21.03.2025 with respect to a similar scuffle, a complaint was lodged and CSR in No.113 of 2025 2/6

was issued by the 3rd respondent Police on 22.03.2025. Thereafter, the petitioner had surveyed the land and had marked boundary stones. While the petitioner had attempted to erect fence, the 4th respondent had threatened the workers and stopped the work. In this regard, the petitioner has sent a representation to the respondents 1 and 2 seeking appropriate police protection for fencing. Since the same was not considered, the petitioner is before this Court.

4. The learned Government Advocate (Crl.Side) on instructions, submitted that the matter is all about a civil dispute between the petitioner and her brother. However, no representation has been received in this regard as contended by the learned counsel for the petitioner.

5. In view of the same, the petitioner is directed to give a fresh representation to the respondent police and on receipt of the same, the 3rd respondent police is directed to afford adequate police protection for fencing. It is made clear that police protection will be afforded only 3/6

after giving an opportunity of hearing to the 4th respondent and the petitioner on producing the necessary documents proving the title with respect to the property to which fencing is sought to be done.

6. With the above directions, this Criminal Original Petition stands disposed of.
