PRAYER: Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, calling for the records and thereby quash clause 9 of G.O.Ms.No.90, School Education Department dated 09.05.2018 as illegal and arbitrary and in consequence thereof direct the respondents to extend the benefit of G.O.Ms.No.216, Finance (PC) Department dated 22.03.1993 to the petitioner and revise the pension of the petitioner. The very same Government Order which is challenged in this writ petition was challenged earlier by similarly placed persons.
2. The Full Bench of this Court by its common order dated 09.12.2016 in the writ petitions filed by similarly placed persons has granted favourable orders to those petitioners who are similarly placed as that of the petitioner in this writ petition. However, in the Full Bench order dated 09.12.2016 referred supra, it has been made clear that the benefit granted to the petitioners in the Full Bench decision cannot be made applicable to the persons who had not approached the 2/5
Court before 09.12.2016. The operative portion of the said direction is reproduced hereunder.
"38(iv). It is further made clear that the benefits as directed above, shall be extended to the parties who are before this Court alone and no fresh Writ Petitions would be entertained on and from 09.12.2016"
3. In view of the aforesaid direction of the Full Bench of this Court, this writ petition is not maintainable since this writ petition has been filed in the year 2022, i.e., only after 09.12.2016.
4. Accordingly, this writ petition is dismissed. No costs. Consequently, connected Miscellaneous Petition is closed.
