ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.1 and 2 in Crime No.115 of 2015 on the file of the respondent police was arrested and remanded to judicial custody for the alleged offences punishable under Sections 147, 148, 294(b), 392, 397 and 506(ii) IPC, and hence, seek bail. 2.The case of the prosecution is that on 04.05.2014, after taking meals in a hotel, the accused picked up quarrel with the owner of the hotel for non payment of the bill amount and when it was questioned by the defacto complainant, who is the Head Constable, the accused attacked him. 3.The learned counsel for the petitioners would submit that the petitioners have been falsely implicated in this case and he would further submit that due to misunderstanding between the accused and the Head Constable viz., Mr.Ganesmoorthy, they have been falsely implicated and that the petitioners were detained under Act 14 OF 1982 and the same was revoked by the advisory board.
4.Per contra, the learned Government Advocate (crl. Side) submitted that the accused are habitual offenders and they have three previous cases. 5.The learned counsel for the petitioner has given details about the cases filed against these petitioners and except the present case other cases are for the offences under Sections 323 and 506(ii) IPC.
6. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned District Munsif cum Judicial Magistrate, Kerranur, Pudukkottai and on https://hcservices.ecourts.gov.in/hcservices/
further condition that the petitioners shall appear before the learned District Munsif cum Judicial Magistrate, Kerranur, Pudukkottai daily at 10.00 a.m. until further orders.
