ORDER : The Court Made the following order :- The petitioner, who is arrayed as an accused in Crime No.496 of 2015 on the file of the respondent police apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 147, 148, 448, 294(b), 307, 506(ii) and 302 of I.P.C @ 120(b), 147, 148, 294(b), 302 and 307 of I.P.C and hence, seeks anticipatory bail.
2. According to the prosecution, the deceased married A1's sister in the year 2011 and both of them belong to different community and due to which on 22.06.2015, the accused 1, 2 and 4 waylaid the deceased and done to death.
3. The learned counsel for the petitioner submitted that the prime accused were arrested and based on the confession of the first accused, the petitioner is implicated as seventh accused in this case and even as per the confession, the prime accused had taken lunch in the house of the petitioner before commission of the offence and she assured to bear the litigation expenses. He further submitted that the petitioner is a lady aged about 35 years and he has been unnecessarily roped in this case with ulterior motive and he further submitted that the petitioner is an innocent lady and she has not committed any offence as alleged by the respondent.
4. The learned Government Advocate(Crl. Side) on instructions submitted that the prime accused have been secured and they are in judicial custody and as per the confession of the arrested accused, https://hcservices.ecourts.gov.in/hcservices/
the petitioner is added as accused in this case. He further submitted that the petitioner is one of the conspirators for the commission of offence.
5.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on her appearance before the learned Judicial Magistrate No.I, Kovilpatti and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m., until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
6. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
